Ken Krayeske, a freelance journalist, photographer, and law student who was arrested while taking photographs during Gov. M. Jodi Rell’s inaugural parade in January, filed a federal civil rights lawsuit Thursday against the City of Hartford and its police officers involved in his “false arrest.”
You already know the story.
Krayeske made a state police hit list for his political activities, including his role as campaign manager for Green Party candidate Cliff Thornton who ran against Rell in the Nov. 2006 election.
The federal lawsuit claims that prior to the inaugural parade a member of the Connecticut State Police informed Hartford Police that Krayeske “was among a group of political activists who posed a possible threat to the governor.” But the state dropped the charges in March when it discovered there wasn’t enough probable cause to prosecute Krayeske. The HPD has a history of writing fiction in their arrest warrants, too. The applicant/officer often says “he” witnessed such and such when it was someone else doing the alleging and witnessing. That will undoubtedly come out on this case as the HPD officer who signed the arrest doc claimed to observe something that he never saw but a state cop said he had observed and as we no all know the state cop lied to set the HPD up on this. Oh what a tangled web….

I’m thinking $50-100K in a quick settlement, otherwise $10-$50K after a very embarassing trial.

The perfect settlement would be for the Kens Law school to be paid for out of reductions in the “Intelligence” budget of the state police. Since nobody their seems to have had any Intelligence of any kind there anyway it should harly be missed.

KK did nothing wrong. That’s why the chargers were dropped. The Hartford Police can’t say the same.
I’d also like to point out that KK was put on a watch list in part because of innocuous comments he made on CTLP. No matter what your political leanings, everyone who comments here should be concerned about that.

Cocaine dealers and rapists get charges dropped every day because there is not probable cause so color me unimpressed. I think he should just consider himself lucky to get off scott free.

Yes I did. It was widely available online, including here at CTLP. In fact the police report is what blew holes right through the validity of Ken’s arrest. Read Gabe’s post on this for more.
Except KK didn’t do that. He’d already taken several pictures of Rell before the police even noticed him. He didn’t charge towards her on his bike, and there are eye witness reports that corroborate Ken’s version of events.

Just to be clear though- I respect your opinion of the situation and I can’t stress enough that you are free to express a desire for Keith to win in court. Hopefully though you understand that I simply hold the opposite view. There was a time when people were far less litigious than today, but I realize that times change and people are far more likely to sue than they once were. Clearly Keith was not guilty of any crime, but that does not mean the police are not free to detain him in certain situations. Also clearly Keith does not deserve to be in jail or anything and I am happy for him. However, I think his lawsuit is frivilous. Whether it has merit is ultimately for the factfinder to decide and I do not presume to hold that role.

1) Reasonable to detain? For how long? You think it’s okay for the police to grab you off the street, and hold you for over twelve hours with no cause?
2) Bail. They set the bail for a non-violent, breach-of-peace, offense at a ridiculous $75,000. You think anyone else has ever been assigned that high a bail for “breaching the peace”?
3) Probable cause. The state pressed forward with the most ridiculous of cases, (based on official mis-statements, btw.) Based on this KK had to miss work and pay for an attorney. All of which would be beside the point, if only it hadn’t been a strictly political arrest!
Repeat after me. No one in Connecticut should ever be arrested/harassed by the police b/c of their political views….

I don’t expect you’ll understand all they encompass but just reading them is a start and Honors all those troops you’re so sure you’re supporter by always following orders from whatever authority figure is put in front of you.
1.) It’s a well established rule that the police can detain people in certain situations as long as they have probably cause. Sounds like Keith is some kind of local character of interest and frankly I would be utterly shocked if this is solely because of his blog comments. If you’ve ever worked on a campaign then you know that there are some usual suspects who get overly pushy, loud, obnoxious, and downright violent. On top of that- no matter what you may believe the reality is that police assigned to protect elected leaders have leeway to detain people they see as a threat to that leader’s safety. Honestly, I thought this was common sense. If you guys honestly believe that given the world we live in that there is not a certain parameter and legal protocol for getting physically close to leaders like a governor, senator, president, then you are hugely out of touch.
2.) Ok, so now the judge is in on the conspiracy too? Who’s next? Maybe Larry Cafero…
3.) It’s there right to press charges just as much as it is Ken’s right to sue them. Obviously we are free to weight in on how we feel about the outcome.

I have read the bill of rights– knowledge is not the issue here, but rather interpretation. I know you have an emotional reaction, but your response shows a lack of critical analysis.

The judge didn’t set the initial bail of 75K - it was set by the HPD at the station. When Ken saw an actual judge, at the jail, the judge knocked the bail down to RoR.
On Probable Cause, reading the arrest report and comparing it to pesky (and provable) facts renders the report impossible (not to mention that at least one eyewitness directly contradicts the police account.

You should let HPD know; I’ve heard it reported (I can’t remember where, so no link, but my bet is the Courant) that someone walked out of the crowd and shook the Governor’s hand. Result: Not arrested. Ken took 23 pictures. Result: Arrested.

toucan, trueblue, cgg: Go find out what parade the Governor is in this weekend, then get together one of you with a video camera, the other with a bike, and re-enact the event. Ride up to the parade, jump out into the parade route directly in front of the governor, and snap away.
If you’re right, nothing will happen. If you’re wrong, you’ll get arrested, then you can sue, become rich, and then donate all the money to GC so he doesn’t have to scrounge for spare change to run this site.
Hate to break it to you on this one, guys, but Krayeske’s case is by no means a slam dunk. He’s got some serious evidentiary issues if he’s going to prove his 1983 case against the State. It’s not like the police just hauled him in because he was riding a bike really fast while wearing a backpack. He was pedaling toward the Governor’s parade and then jumped from his bike. As Stan Simpson accurately argued, if the police had done nothing, then they should have been fired.
This will end in a decent settlement for Ken, but he’s not going to get what he thinks he’s owed — nothing close to it, actually. Of course, this will be a fantastic educational opportunity for him, if he brings the case by himself.
Has anyone thought about who the heck is going to represent the state cop sued in the complaint? The AG threw everyone involved under the bus — I think My Left Nutmeg had coverage of his comments to Colin McEnroe — and his office represents the state police.
KK and his attorney will profit only b/c the state cops and the HPD lied their asses off, as if the internet revolution never happened.
How can they argue they thought Ken K. was a threat, when two weeks later the Governor herself poses for a photo with KK?
Again, I believe that everyone wants this to go away, and no one wants subpeonas and testimony. Based on that, I think Perez and Co. quickly offer a generous settlement to KK and his attorney.
If they don’t the media will quickly seize on the lies, and this will devolve for everyone involved. I guess the ultimate question is who will be the HPD/State police fall guy…

Are the Republicans here going to try to spin this as the Gen. Patraeus Surge was a success so 50,000 troops can now leave or are they fine with accepting the Surge was a total failure even before all the troops have arrived.
I predicted Patreaus would be thrown under the bus in August and have to admit this administration doing it before the summer solstice is suprising.

Hillary is definitely focusing on the Democratic primary and the desires of moveon.org. In my opinion, this definitely shows that she is not on cruise control. She must feel very threatened by Obama.
The (non)existence of the war on terror will clearly be the dominant issue for next year’s presidential election.
One thing which is interesting is that the war on terror was such an important issue in 2004 (it was the key issue for Howard Dean’s early rise in 2003), yet GWB won the presidential election. It will again be the dominant issue for the presidential election in 2008, but the Republican candidate will not necessarily be so closely tied to GWB. So, it will be interesting to see if the events since November 2004 are enough to sway the election to a Democrat.
Although I do not in any way support Obama, I can understand how he can give people the feeling of a “fresh start.” And a lot of Americans would probably like to pretend that they can have a “fresh start” …

What is going on in Connecticut is just plain scary. So, with Kryeske there is proof that the Connecticut State Police can have a political enemies list and then arrest those on that list on sight.
